Your License Will Be Suspended!
If you took the breath test and received a reading of .08 percent breath alcohol level or greater, or refused to the breath test, your license will be suspended in 10 DAYS from the date of your DUI ticket, unless you request a hearing challenging the suspension.
YOU HAVE 10 DAYS from the date on the ticket in which TO MAIL OR DELIVER YOUR REQUEST FOR A HEARING! If your request for hearing is not POSTMARKED or RECEIVED within TEN DAYS; your license will be suspended for 6 months if you took the breath test and received a .08 percent breath alcohol level or your license will be suspended for 12 months if you refused to take the breath test. If you had a prior refusal to take the breath test, then your license will be suspended for 18 months.
IF YOU DO NOT REQUEST A HEARING, YOU WILL LOSE YOUR RIGHT TO A HEARING AND WILL LOSE YOUR LICENSE. A hearing does not guarantee you will get your license back, but is your only chance to do so. All this is explained to you on the back of your DUI ticket.
You must request a hearing in order to fight the suspension. If you do not fight the suspension, then you will not be able to receive a work license for 30 days if you received a reading of .08 percent breath alcohol level or greater. If you refused the breath test you will not be able to receive a work license for 90 days. If you have a prior DUI or prior refusal to take a breath test you cannot get a work license for at least 12 months.
A COPY OF THE FORM USED TO REQUEST A HEARING CAN BE REQUESTED FROM OUR FIRM. There is no fee to the Driver License Bureau for filing a request for a hearing. You should complete and deliver the request form to the local Bureau of Driver Improvement office.
